PrintLab Design Submission Agreement
The terms you accept when you upload your own artwork to PrintLab: your warranties of ownership and lawful content, the limited licence you grant us to print, and how long we keep your file.
Agreement to Terms
Your statutory rights are protected. Nothing in this Agreement limits or excludes any rights you may have under the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or equivalent consumer protection legislation applicable in your jurisdiction (including the UK Consumer Rights Act 2015 and the EU Consumer Rights Directive 2011/83/EU as transposed in your country of residence). Your statutory rights prevail over anything inconsistent in this Agreement.
By checking “I agree” and uploading a digital design file (“Design”) to PrintLab on any of The Fabric Shop’s websites (thefabricshop.com, our primary website, and the regional domains thefabricshop.au, thefabricshop.uk, thefabricshop.eu, and thefabricshop.us, which route to it), you (“Customer”) enter into this Agreement with The Fabric Shop Pty Ltd (ABN: 69 693 515 687) (“The Fabric Shop”, “we”, “us”, “our”).
This Agreement supplements, and is incorporated by reference into, our Terms of Service, Privacy Policy, and IP & Takedown Policy. Capitalised terms have the meaning given in the Terms of Service unless otherwise defined here.
Your Warranties
By submitting a Design, you represent and warrant to us that:
(a) Ownership or licence. You are the sole legal owner of all rights in the Design, or you hold an express written licence or permission from the rights holder sufficient to have the Design printed on fabric for your intended use.
(b) No infringement. The Design does not infringe the copyright, trademark, trade dress, publicity, privacy, or moral rights of any third party. This includes, without limitation, characters and imagery owned by entertainment studios, publishers, or sporting bodies; brand names, logos, and trade dress of other businesses; artwork created by another artist without permission; and the image or likeness of any identifiable real person without their consent.
(c) No prohibited content. The Design does not contain material that is defamatory, obscene, sexually explicit, sexualises minors, is hateful or incites violence, depicts graphic violence or animal cruelty, promotes terrorism or other unlawful activity, or is otherwise unlawful in (i) Australia, (ii) any jurisdiction in which we or our fulfilment partners reproduce, print, or manufacture products, or (iii) your country of residence.
(d) Tools and AI. The warranties in paragraphs (a) to (c) apply to your Design however it was created, including where you used any digital or AI tool. We may decline to print, or remove, any Design where, in our reasonable opinion, the legal or reputational risk is unacceptable.
No review or clearance by us. We do not review Designs for intellectual property clearance or legal compliance before printing. Accepting an upload or printing an order is not confirmation that your Design is non-infringing or lawful, and does not transfer responsibility for the content of your Design from you to us.
Technical Requirements
You are responsible for ensuring your file meets the requirements set out below. We are not responsible for poor print quality resulting from files that do not.

Our Licence to Print Your Design
You retain full ownership and all intellectual property rights in your Design. You grant The Fabric Shop Pty Ltd a non-exclusive, royalty-free, worldwide licence to use, reproduce, and modify your Design (for technical printing purposes only, for example, rescaling, tiling, and colour-profile conversion) solely for the purpose of fulfilling your order, and to transfer the Design to our overseas fulfilment partner for the same purpose. Each transfer is limited to what is necessary to fulfil the orders to which it relates, and the Design is removed from the fulfilment partner’s systems once those orders are complete. Cross-border handling of your Design and any associated personal information is described in our Privacy Policy.
This licence does not permit us to sell your Design to any other customer, include it in our Design Partner library, or use it in any marketing, advertising, or promotional material, in each case without your separate express written consent.
Our Right to Refuse or Remove a Design, and Consequences of Breach
We may, at our sole discretion and without obligation to you, refuse to print or remove from our systems any Design that we believe breaches this Agreement (including the warranties and content standards in clause 2) or our Terms of Service, or that exposes us to legal, regulatory, or reputational risk. Where you breach the warranties in clause 2, we may also, separately or in combination:
- cancel your order and, where appropriate, refund the price paid (less any costs reasonably incurred);
- remove the Design from your account library and from any active or pending order;
- suspend or terminate your account in accordance with clause 15.2 of the Terms of Service;
- report the upload, and provide records relating to it, to a rights holder or law enforcement where we are required or reasonably consider it appropriate to do so, subject to the confidentiality limits in our IP & Takedown Policy and Privacy Policy; and
- recover from you, under clause 6 of this Agreement and clause 14 of the Terms of Service, any loss, cost, or expense we suffer as a result of the breach.
If we refuse to print before production has commenced, your order will be cancelled and refunded in full. The position where refusal occurs after production has commenced is governed by clause 11 of the Terms of Service. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss arising from our refusal to print a Design that breaches this Agreement.
Indemnity and Retention
You indemnify The Fabric Shop in accordance with clause 14 of the Terms of Service in respect of any claim, loss, or expense arising out of your breach of this Agreement or the content of your Design.
We retain a copy of your Design only for as long as is needed to fulfil your order and to handle any remake or fault claim, and it is deleted within 30 days of fulfilment of the order to which it relates (or earlier on your request). We do not maintain a reorder library: to reorder a design, upload the file again. You should maintain your own backup copies of your Designs, and we are not liable for loss of or damage to design files except to the extent caused by our failure to take reasonable care. Retention and deletion practices are described in Sections 5.5 (design storage and deletion) and 9 (data retention) of the Privacy Policy.
